Suicide or Murder?

My 19 y/o son, Joshua, was found dead in Amsler Park/McGregor, Tx on February 16, 2006. McGregor PD did not investigate and the autopsy does not list an etiological specific disease/injury to attribute to his death.

I knew, from the beginning, that my son would not kill himself, but had to remain objective and consider the possibility.

The PD didn't show up to escort the funeral procession, although I had scheduled and paid for this service, telling me, "We were unavailable." This is not true, as our procession almost collided with a patrol car enroute to the cemetary.

I analyzed the crime scene photos, dispatch logs, the statement of the four officers, and the autopsy. The on duty officers were telling me that they did not have time to do their hourly 'park check', although I did find out that Joshua was seen in the dark park @ 1AM by a patrol officer. I found this out from an associate with Southwestern Inst. of Forensic Science, but when I asked the PD about this, they acted as if they had no idea of what I was talking about. As of today, I still don't know which officer it was.

All 8 McGregor officers knew my two sons, especially Joshua. Even though he was recognized in the dark park, the four officers, on scene, stated they did not recognize him upon arriving on the scene. Yet, one officer did a wants and warrants check on the unknown subject, with NO identification and no suicide note!

In June, 2006, four of the five officers, on scene, resigned simultaneously, for unknown reasons.

I asked pertinent questions of the former Interim Chief, the former successive chief, and the current chief/former Texas Ranger:

1) How and why run a wants and warrants check on an unknown subject with no identification?

2) How is it possible for former Officer Kirby to have been the first on scene, as his patrol car (#1507) was NOT dispatched to Amsler Park?

3) Why was former Sgt. Freeman called on duty @ 4:37AM?

4) Why wasn't this death investigated as a homicide until PROVEN otherwise?

The only answer: From former successive chief~"It's not like the officers have drivers license numbers in their heads. A wants and warrants check is done in case there's a warrant, it can be dismissed." I said, "Who cares, he's dead!"

Amsler Park has a 10PM curfew for everyone. Did the patrol officer attempt to arrest Josh for curfew violation or was Josh asked to vacate the park? I can't see McGregor PD not taking advantage of an opportunity to NOT arrest Josh!

I contacted the Texas Rangers, specifically Steve Foster/Company F to ask the Rangers to investigate my son's suspicious death. He denied my request several times over the course of 2 years............and then became Chief of Police/McGregor! Coincidence? I don't think so!

I have hired a private investigator, but she took the information I gave her, wrote it up in a report, and charged me an exhorbitant amount of money for this!

There's a lot more to this story than I can include at this time, but I still don't believe my son killed himself. I spent 3+ years researching this case, teaching myself basic forensics, medical terminology to understand the wording of the autopsy, suicide statistics, judicail/suspended hangings, digestion processes pertaining to time of death, etc.

I now believe that McGregor PD murdered my son. I don't think it was an intentional murder, but it's murder, nonetheless.

I have contacted every local/state/federal entity to get justice, to no avail.

I requested an Internal Affairs Investigation. Denied. I requested an Equivocal Death Investigation. Denied. I requested a formal inquest, per the Texas Code of Criminal Procedures, Articles 49.04 and/or 49.18. I was denied by the Justice of the Peace.

The autopsy has to be incomplete, as I mentioned. I have contacted the Medical Examiner, but he won't even consider another manner of death. He did tell me he initially ruled Undetermined until receiving an oral report from former Det. Martin, causing him to change the ruling to Suicide. He also said there was no evidence of strangulation.

Martin's report:

"Reportedly, Josh was a drug user."

"Joshua and mother fought the previous night."

"App. suicide by chain vs. neck."

The complainant told me he called 911 @ 5:15AM. McGregor dispatched ONE officer to Amsler Park @ 5:35AM..For Possible Suicide" arriving on scene @ 5:36AM! The officer ran the wants and warrants check @ 5:44AM!

After he was removed from the chain, the back of his shirt was pulled down, revealing ROBINSON tattooed across his upper back. An officer commented, 'because of the proximity to the Robinson's home, they figured he must be a cousin they have never dealt with.'

Its too bad the PI did not do his job. My first inclination was for you to do that, which you did.

Its really hard to give you an answer, or even an honest assessment. Unless someone has some real information on Yedda to pass to you, there is no True answer to give you, only advice and thoughts. I will read the website and information you linked to.

I am very sorry for your loss. My only thought is to get a the media interested this case. If not mainstream, then independent. Have you requested any and all public records regarding the five officers, on scene, who resigned simultaneously for unknown reasons? sounds like you have. I would pursue this aspect as far as I possibly could.

Although I cant know what it is like to loose a son. Being a son myself. I know I would want my mother to be at peace with my passing and not have unanswered questions continue to haunt her for too long. Although the pursuit of the truth and to have justice is more than understandable. And I can understand your relentless pursuit.

Ill check out the website you posted. I am sure you have requested any previous complaints about the Police officer in question? One question I would have for the coroner if it was "POSSIBLE" he was tazered?

The Post At Americaswatching.org is very detailed. Can you or ANYONE answer the question. Can she as the mother demand or pay for an Independent autopsy?

After reading the details i understand more your continued pursuit of answers.

I would want to know where every relative and friend of his girlfriends family was at the approx time of his death.

I have a possibility for you. The renowned forensic specialist and lawyer, Dr. Cyril Wecht, has a service for free. You write to him and send him info on your son's case, briefly, as you've done here. Let him know the forensics; send him Joshua's autopsy. He will, in turn, call you in about 2 days. You have probably seen Dr. Cyril Wecht on TV. Here's his email: chwecht@fyi.net. He will give you an opinion and maybe what you can do legally. Good luck. Keep us posted.

Send him a brief summary of your son's case, as you have here. Send him a copy of the autopsy, everything you have. I can't promise anything to you. He's a renowned forensic specialist and a lawyer as well. Maybe he can steer you to something you can do legally. Send him anything forensic. He will call you in about 2 days. Here's his email:
